Upon arrival you will be required to sign a
"liability release - assumption of risk - responsibility" form. A
copy of the form is shown below.
I,__________, waive and release any and all claims for damages,
including claims for negligence, for myself, my heirs and other
representatives and assigns which I may have as a consequence of my
tour and/or rental. In particular, but without restricting the
generality of the foregoing, I hereby release from liability and
agree not to sue Bear Tracks ATV, its agents, officers, directors,
employees, independent contractors, guides and/or representatives.
I,__________, am aware that all packages/services expose me to many
risks, hazards and dangers (both known and unknown). I accept all
risks, hazards and dangers to which I may be exposed and acknowledge
the possibility that I may suffer loss resulting there from. I
further acknowledge that such personal injury, death, illness, and
property damage or property loss may result from the risks inherent
in any package and/or renting or may result from the negligence or
faults of Bear Tracks ATV, its agents, officers, directors, employees,
independent contractors, guides and/or representatives. I am freely
and voluntarily assuming all the risks and hazards, and I am
participating in the activity and/or rental as provided by Bear
Tracks ATV entirely at my own risk.
In entering into this agreement, I am not relying on any oral,
written or visual representations or statements made by Bear Tracks
ATV or anyone else to induce me to participate in a tour or to
take a rental as offered by Bear Tracks ATV.
I agree and comply with all terms and conditions of the tour
registration forms. I have read and fully understood the contents of
this agreement prior to signing it, I am signing it freely and
voluntarily and I agree that this agreement will be binding on me,
my heirs, executors, administrators, personal representatives and
assigns.
